Abstract

Forest destruction is the process, method or act of destroying forests through illegal logging activities, use of areas without permits or permits that are contrary to the aims and objectives of granting permits in forest areas that have been determined, have been designated, or are being processed for determination by the government. The aim of this research is to analyze the Supreme Court decision no.542 k/Pid.Sus-LH/2024 concerning Forest Destruction. The method used in this research is normative law, which emphasizes the analysis of positive legal norms such as statutory regulations and court decisions. Based on the Supreme Court judge's decision regarding the sanctions issued, the defendant was sentenced to prison for 2 years and a fine of 1 billion with the provision that if he could not pay, he would be sentenced to imprisonment for 3 months.
