Abstract

Indonesia is a country that applies various laws and regulations in its territory so that this country is called a state of law. Therefore, all issues concerning the life of the nation and state are shaped by the rule of law as the main foundation. The reference in making the law is the majority of the law adopted by Islam, because in the territory of Indonesia many residents are Muslim with the perspective of forming state regulations based on the first Pancasila. There are many controversies in elevating Islamic law in the formation of national law because of the many religions that exist in Indonesia. The adoption of Islamic law pays attention to the government because of all the demands of Islamic law so that national law must ignore all aspects that will be applied without conflicting with Islamic law.
